Minutes of the Planning Committee Meeting – Thursday 7th October 2021 – 7.30pm Mistley Village Hall

1. Nomination of Chairman of the Committee – Councillor Nutter was nominated to serve as Chairman for the ensuing year. This was agreed following the vote. (Proposed by Councillor Carter and seconded by Councillor Peacock).

2. Nomination of Vice Chairman of the Committee – Councillor Carter was nominated to serve as Vice Chairman for the ensuing year. This was agreed following the vote. (Proposed by Councillor Bell and seconded by Councillor Frost).

3. Welcome and Apologies for Absence – Apologies for absence were received from Councillors Coiley (family), Howell (work) and Kent (family). The Committee agreed these apologies.

4. Public Voice – No Members of the Public were present.

5. Declarations of Interest – None.

6. Minutes of the Previous Planning Committee Meeting – The Minutes of the Planning Committee Meeting held on the 2nd September 2021 were received, considered and agreed following the vote. (Proposed by Councillor Frost and seconded by Councillor Peacock). (Copy in Minute Book and on Website).

7. Matters Arising/Updates from Previous Minutes – There were no matters.

8. The Committee noted Planning Decisions from the LPA (Local Planning Authority) as follows:

a) 21/01431/TCA – (Tree Conservation Area) – 1 Elmdale Drive, Manningtree – (cross-boundary application) – Gold Cypress Conifers – reduce down to an average of 10ft, 2 No. previously reduced, Cherries – reduce but take out an extra 1m of the originals – The Committee noted that the LPA has approved this application.

b) 21/01197/FUL – (Full Householder) 25 Kiln Lane – Proposed part removal of existing conservatory and erection of replacement with tiled roof and new glazing – The Council noted that the LPA has approved this application.

c) 21/01259/LBC – (Listed Building Consent) – 3 Thorn Mews, The Green – Proposed replacement of render to improve home appearance and help appearance and help to insulate and protect against the elements – The Committee noted that the LPA has approved this application.

d) 21/0040/FUL – (Full Householder) – Topsl House, High Street – – Proposed external changes to fenestration including: The change of a window to a door to the front elevation and change of a window to a door to the Quay elevation – The Committee noted that the LPA has approved this application.

e) 21/01673/TCA – (Tree Conservation Area) – Stonehouse, School Lane – Laurel and Holly hedge – reduce in height to level, neighbouring Ash Trees – reduce overhang as much as possible. 1 No. Hazel – fell and 1 No. Horse Chestnut – fell – The Committee noted that the LPA has approved this application.

f) 21/01457/TCA – (Tree Conservation Area) – Swan House, High Street – 1 No. Holm Oak – Maintenance reduction as previous years – The Committee noted that the LPA has approved this application.

g) 21/01503/TCA – (Tree Conservation Area) – 1 Croft Cottage, The Chase – 1 No. Silver Birch – Reduce crown by 2-3 metres back to suitable growth points -The Committee noted that the LPA has approved this application.

9. Planning Applications/Proposals received from the LPA (Local Planning Authority):

a) 21/01503/TCA – (Tree Conservation Area) – 1 Croft Cottages, The Chase – 1 No Silver Birch – Reduce by 2-3 metres back to suitable growth points – The Committee noted that the LPA’s Tree and Landscape Officer has already made a decision under the LPA’s scheme of delegation and approved the proposal.

b) 21/01377/LBC (Listed Building Consent) – Mistley Church Hall, New Road – Repair water damage to kitchen ceiling. Replace wooden doors at rear of building on WWII extension. Investigation and remedy leaks to corrugated roof on WWII extension – Following the vote, (proposed by Councillor Frost and seconded by Councillor Peacock), the Council raised no objections to this proposal.

c) 21/00883/FUL/HH (Full Householder) – Old Orchard House, Norman Road – Installation of 14 solar panels to south facing elevation of roof – Following the vote, (proposed by Councillor Frost and seconded by Councillor Bell), approval was recommended. The Committee would welcome this proposal as it will assist with environmental and green matters.

d) 21/01623/TCA (Tree Conservation Area) – Beech House, Norman Road – 1 No. Plum – Reduce crown by 1.5 metres – Following the vote, (proposed by Councillor Frost and seconded by Councillor Bell), it was agreed to recommend that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation.

e) 21/01452/TCA – (Tree Conservation Area) – 2 Nelson Villas, The Park – 1 No Silver Birch – Following the vote, (proposed by Councillor Frost and seconded by Councillor Bell), it was agreed to recommend that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation.

f) 21/01674/TPO – (Tree Preservation Order) – Stonehouse, School Lane – 1 No. Sycamore (neighbouring) prune to reduce majority of overhang – Following the vote, (proposed by Councillor Frost and seconded by Councillor Bell), it was agreed to recommend that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation.

10. Planning Applications received from the LPA after Agenda distributed

a) 21/01673/TCA – (Tree Conservation Area) – Stonehouse, School Lane – Laurel and Holly hedge – reduce in height to level, neighbouring Ash Trees – reduce overhang as much as possible. 1 No. Hazel – fell and 1 No. Horse Chestnut – fell – The Committee noted that the LPA’s Tree and Landscape Officer has already made a decision under the LPA’s scheme of delegation.

b) 21/01584/FUL – Acorn Village Community, Clacton Road – Proposed construction of Wellbeing Room on the grounds of Acorn Village – Following the vote, (proposed by Councillor Frost and seconded by Councillor Carter), the Committee recommended approval.

c) 21/01602/FULHH (Full Householder) – 1 Rosewood Park – Proposed single storey rear extension – Following the vote, (proposed by Councillor Bell and seconded by Councillor Carter), the Committee recommended approval as similar extensions are already evident in this area.

d) 21/00197/DETAIL – Revisions – Land to the South of Long Road and to West of Clacton Road – Reserved matters application with details of appearance, landscaping and scale pursuant to the residential element of outline permission (17/01181/OUT – Approved under appeal APP/P1560/W/19/3220201) including up to 485 dwellings, public open space and infrastructure – The Committee noted that this proposal is now for 483 dwellings. The other changes within the detail were also noted. The Committee has previously objected to this scheme going back to 2017, which was approved under appeal. However, at this stage the Committee simply noted the revisions and changes.

e) 21/01607/FUL (Full Householder) – 1 Harwich Road – Proposed Conversion of part of the ground floor into a separate two bedroomed flat, including parking and private amenity space – Following the vote, the Committee recommended approval. (Proposed by Councillor Frost and seconded by Councillor Bell).

11. Public Inquiries, Appeals or Enforcement Matters – There were no matters.
