Minutes of the Planning Committee Meeting – Thursday 4th November 2021 – 7.30pm Mistley Village Hall

1. Welcome and Apologies for Absence – Apologies for absence were received from Councillors Bell (work), Coiley (clash of Meetings), Frost (unwell) and Howell (work), These apologies were agreed by the Committee. Councillor Kent was not present and did not send an apology for absence.

2. Public Voice – No Members of the Public were present.

3. Declarations of Interest – None.

4. Minutes of the Previous Planning Committee Meeting – The Minutes of the Planning Committee Meeting held on the 7th October 2021 were received, considered and agreed following the vote. (Proposed by Councillor Carter and seconded by Councillor Peacock). (Copy in Minute Book and on Website).

5. Matters Arising/Updates from Previous Minutes – There were no matters.

6. The Committee noted Planning Decisions from the LPA (Local Planning Authority) as follows:

a) 21/01723/TCA – (Tree Conservation Area) – Acorn Village, Mistley Hall, Clacton Road – 1 No. self-seeded Sycamore – remove – The Committee noted that the LPA has approved this application. It also noted that the Tree and Landscape Officer of the LPA was unable to extend the timescales for the Committee to make observations on this proposal.

b) 21/00213/OUT – (Outline Planning Application) – Land South of Long Road – Variation of Condition 3, (Approved Plans) and 12 (highway proposal drawings) of approved planning application 17/01181/OUT, (Approved under appeal APP/P1560/W/19/3220201) – – The Committee noted that the LPA has approved this application.

c) 21/01623/TCA – (Tree Conservation Area) – Beech House, Norman Road – 1 No. Plum – reduce crown by 1.5 metres – The Committee noted that the LPA has approved this application.

d) 21/01674/TPO – (Tree Preservation Order) – Stonehall, School Lane – 1 No. Sycamore (neighbouring) prune to majority of overhang – To note that the LPA has approved this application.

7. Planning Applications/Proposals received from the LPA (Local Planning Authority):

a) 21/01722/TPO – (Tree Preservation Order) – Acorn Village, Mistley Hall, Clacton Road – 1 No. Chilean Pine (Monkey Puzzle) – remove and replace with a Willow Arbour – Councillor Nutter provided the Committee with an update regarding this proposal. Following the vote, (proposed by Councillor Chaplin and seconded by Councillor Peacock), the Committee recommended that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation, but the Committee wished to emphasis the potential health and safety concerns Acorn Village regarding the tree.

b) 21/01723/TCA – (Tree Conservation Area) – Acorn Village, Mistley Hall, Clacton Road – 1 No. self-seeded Sycamore – remove – The Committee noted that the Tree and Landscape Officer of the LPA was unable to extend the timescales for the Committee to make observations on this proposal.

c) 21/01765/TCA – (Tree Conservation Area) – 2 Millers Reach – 1 No. Twisted Willow – reduce to approx. 13ft in height, 1 No. Holly – reduce to approx. 12-13ft

– Following the vote, (proposed by Councillor Carter and seconded by Councillor Meston), the Committee recommended approval.

d) 21/01659/FULHH – (Full Householder Application) – 8 The Green – Proposed single rear extension works involving demolition of timber frame shed and replacing with single storey structure for domestic use. With refurbishment of existing rear adjoining structure with the retainment of existing roof – Following the vote, (proposed by Councillor Chaplin and seconded by Councillor Peacock), approval was recommended.

e) 21/01660/LBC – (Listed Building Consent) – 8 The Green – Proposed single rear extension works involving demolition of timber frame shed and replacing with single storey structure for domestic use. With refurbishment of existing rear adjoining structure with the retainment of existing roof – Following the vote, (proposed by Councillor Chaplin and seconded by Councillor Peacock), approval was recommended.

8. Planning Applications received from the LPA after Agenda distributed

a) 21/01847/TCA – (Tree Conservation Area) – Elm House, Trinity Road – 1 No. Silver Birch – reduce by up to 3.5 m – Following the vote, (proposed by Councillor Meston and seconded by Councillor Carter) the Committee recommended approval.

b) 21/01867/TCA – (Tree Conservation Area) – The Nook, Norman Road – 1 – Work along back boundary trimming, reducing and removing dead ceanothus, removing elder, reducing syringa, reduce viburnum and apple tree. 2 – Cherry reduce by up to 3.5m to get shape and remove dying pseudoaccacia – Following the vote, (proposed by Councillor Carter and seconded by Councillor Chaplin) the Committee recommended that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation.

c) 21/01868/TCA – (Tree Conservation Area) – 26 Harwich Road – T1 Conifer Hedge – Reduce height by 1.2 metres and trim sides. T2 Conifer Hedge – Reduce height by 1.2 metres and trim sides. T3 – Elder – Reduce crown by 1-2 metres – Following the vote, (proposed by Councillor Carter and seconded by Councillor Meston) the Committee recommended that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation.

d) 21/01788/FULHH (Full Householder) – Matlock, 15 New Road – Proposed porch front, reconfiguration and extension of garage and single-storey side and rear extension – Following the vote, (proposed by Councillor Meston and seconded by Councillor Carter), the Committee recommended approval.

e) 21/01783/FUL – (Full Householder) – 4 Long Road – Proposed replacement of existing conservatory with new – Following the vote, (proposed by Councillor Carter and seconded by Councillor Peacock), the Committee recommended approval.

9. Public Inquiries, Appeals or Enforcement Matters –

a) Five Estuaries Offshore Wind Farm – Scoping Consultation – The Committee received and noted these details. The Committee considered that it did not wish to comment as all of the development is off the coast from Felixstowe and Harwich and so it cannot see it having an effect on Mistley.

b) Appeal Ref APP/P1560/W/21/3269838 – Planning Application 20/00662/FUL

– The Anchor Inn, Harwich Road – The Committee noted that the Planning Inspectorate has dismissed the Appeal. (The Planning Committee of the LPA refused this application)
