Minutes of the Planning Committee Meeting – Thursday 3rd February 2022 – 7.30pm Mistley Village Hall

1. Welcome and Apologies for Absence – Apologies for absence were received from Councillors Coiley (unwell), Frost (funeral), Kent (family), Meston (annual leave), and Peacock (unwell),

2. Public Voice – No Members of the Public were present.

3. Declarations of Interest and Dispensations – None.

4. Minutes of the Previous Planning Committee Meeting – The Minutes of the Planning Committee Meeting held on the 6th January 2022 were received, considered and agreed following the vote. (Proposed by Councillor Bell and seconded by Councillor Carter). (Copy in Minute Book and on Website).

5. Matters Arising/Updates from Previous Minutes – There were no matters or updates.

6. The Committee noted Planning Decisions from the LPA (Local Planning Authority) as follows:

a) 21/02081/TCA (Tree Conservation Area) – Crisp Malting Group Ltd. Mistley Maltings, School Lane – Application for 5 years permission for minor trimming works as part of ongoing annual maintenance. No removal as part of this permission. Removal of 3 No. Trees adjacent to railway line previously approved – for pollard – not removed if possible – The Committee noted that the LPA has approved this application.

b) 21/01961/FULHH (Full Application) – 11 Brunswick Gardens – Proposed installation of UPVC single storey conservatory – The Committee noted that the LPA has approved this application.

c) 21/00046/FUL (Full Application) – Topsi House, High Street – Proposed balcony and window to a door to the Quay elevation – The Committee noted that the LPA has approved this application.

d) 21/02141/TPO (Tree Preservation Order) – 5 Rosewood Park – 1 No. Oak – reduce back off neighbours boundary on the face approximately 3m, reduce top by 3m too. Hollies on boundary cut back off neighbours boundary approximately 2m and reduce in height by approximately 3m – The Committee noted that the LPA has approved this application.

e) 21/02143/TPO (Tree Preservation Order) – 4 Rosewood Park – Row of Limes – re pollard – The Committee noted that the LPA has approved this application.

7. Planning Applications/Proposals received from the LPA (Local Planning Authority):

a. 21/02121/LBC (Listed Building Consent) – 2 Thorn Mews, The Green – Proposed erection of a rear dormer, insertion of 2 no. conservation roof lights to front roof slope and internal alterations. Following the vote, the Committee agreed to recommend that in view of this being a listed building and to ensure that the proposal is sympathetic with the listed structure and that any work preserves and enhances it, that the proposal be considered by the LPA’s Heritage Officer under the LPA’s scheme of delegation. (Proposed by Councillor Bell and seconded by Councillor Carter),

(Proposed by Councillor Howell and seconded by Councillor Cunningham).

d. 22/00016/FUL (Full Householder) – Anchor Inn, Harwich Road – Proposed erection of a front entrance porch – Following the vote, the Committee agreed to ask the LPA if this proposal is appropriate for a commercial property, i.e. full householder consent. (Proposed by Councillor Bell and seconded by Councillor Cunningham).

e. 22/00037/FULHH (Full Householder) – 48 Rigby Avenue – Proposed single storey side extension and front porch – Following the vote, the Committee agreed to recommend approval. (Proposed by Councillor Chaplin and seconded by Councillor Cunningham).

f. 22/00052/FULHH (Full Householder) – 25 Kiln Lane – Proposed part removal of existing conservatory and erection of replacement with tiled roof and new glazing – Following the vote, the Committee agreed to recommend approval. (Proposed by Councillor Cunningham and seconded by Councillor Bell).

g. 22/00102/TCA (Tree Conservation Area) – 14 Malthouse Road, Manningtree (cross-boundary) – 1 No Silver Birch – crown lift by 6 lowest branches – Following the vote, the Committee raised no objection to this application. (Proposed by Councillor Cunningham and seconded by Councillor Bell).

8. Planning Applications received from the LPA after Agenda distributed:

a. 22/00198/TCA (Tree Conservation Area) – Mistley Wood and Trees adjacent to Clacton Road – 1 No. Lime – fell – Clacton Road boundary. 1 No. Wild Cherry – reduce by 3-4 meters. 1 No. Cherry – Fell – Following the vote, the Committee agreed to recommend that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation. (Proposed by Councillor Cunningham and seconded by Councillor Bell).

b. 22/00201/TPO (Tree Preservation Order) – Mistley Hall Cottage, Clacton Road – 1 No. Common Ash – fell. 1 No. Common Oak – fell – – Following the vote, the Committee agreed to recommend that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation. (Proposed by Councillor Cunningham and seconded by Councillor Bell).

c. 22/00203/TPO (Tree Preservation Order) – Spring Lodge, Acorn Village Community, Clacton Road – 1 No. Horse Chestnut – fell – Following the vote, the Committee agreed to recommend that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation. (Proposed by Councillor Cunningham and seconded by Councillor Bell).

d. 22/00/204/TCA (Tree Conservation Area) – Spring Lodge, Acorn Village Community, Clacton Road – 1 No. Holm Oak – reduce dead centre stem, reduce all main stems and branches – Following the vote, the Committee agreed to recommend that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation. (Proposed by Councillor Cunningham and seconded by Councillor Bell).

e. 22/00205/TPO (Tree Preservation Order) – Mistley Hall, Clacton Road – 1 No. Honey Locus – fell due to Ganoderma fungus – – Following the vote, the Committee agreed to recommend that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation. (Proposed by Councillor Cunningham and seconded by Councillor Bell).

f. 22/00206/TCA (Tree Conservation Area) – Mistley Hall, Clacton Road – 1 No. Sycamore – fell. 1 No. Silver Birch – remove – Following the vote, the Committee agreed to recommend that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation. (Proposed by Councillor Cunningham and seconded by Councillor Bell).

g. 22/00207/TPO (Tree Preservation Order) – Catkins Corner, Acorn Village Community, Clacton Road – 1 No Maple – fell – Following the vote, the Committee agreed to recommend that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation. (Proposed by Councillor Cunningham and seconded by Councillor Bell).

h. 22/00208/TCA (Tree Conservation Area) – Catkins Corner, Acorn Village Community, Clacton Road – 1 No Walnut – fell. 1 No. Silver Birch – fell – Following the vote, the Committee agreed to recommend that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation. (Proposed by Councillor Cunningham and seconded by Councillor Bell).

9. Public Inquiries, Local Plan, Appeals or Enforcement Matters –

• Appeal – APP/P1560/W/21/3268225 – Land off Trinity Road – Proposed erection of 65 dwellings – The Committee noted that the appeal is dismissed.

• Tendring District Council Local Plan – The Committee noted that Section 2 of the Local plan was adopted by the LPA on the 25th January 2022.
