Minutes of the Planning Committee Meeting – Thursday 2nd September 2021 – 7.30pm Mistley Village Hall

1. Welcome and Apologies for Absence – The Committee were sad to hear that Jamie Cambridge the previous Chairman of the Committee has stepped down from the Parish Council. Apologies for absence were received from Councillor Chaplin (family), Councillor Coiley (family), Councillor Frost (unwell) Councillor Howell (work) and Councillor Lawry (work). Councillor Kent was not present and did not send an apology for absence.

2. Public Voice – No Members of the Public were present.

3. Declarations of Interest – Councillor Bell declared personal interests in agenda items numbered 7 e) and 8 a) as he is a nearby neighbour.

4. Minutes of the Previous Planning Committee Meeting – The Minutes of the Planning Committee Meeting held on the 5th August 2021 were received, considered and agreed following the vote. (Proposed by Councillor Carter and seconded by Councillor Peacock). (Copy in Minute Book and on Website).

5. Matters Arising/Updates from Previous Minutes – There were no matters.

6. The Committee noted Planning Decisions from the LPA (Local Planning Authority) as follows:

a) 21/00662/FUL – 24 Erskine Road – Proposed hardwood greenhouse with attached shed with a red brick base – The Committee noted that the LPA has approved this application.

b) 21/01027/FUL – 1-31 Secret Bunker, Shrubland Road – Removal of Condition 9 of planning permission 20/00648/FUL (relating to works on Harwich Road) – The Committee noted that the LPA has approved this application.

7. Planning Applications/Proposals received from the LPA (Local Planning Authority):

a) 21/01431/TCA – (Tree Conservations Area) 1 Elmdale Drive, Manningtree (cross-boundary) – Gold Cypress Conifers – reduce but take an extra 1m off the original cuts – Following the vote, the Committee recommended that the LPA’s Tree and Landscape Officer should make a decision under the LPA’s scheme of delegation. (Proposed by Councillor Bell and seconded by Councillor Carter).

b) 21/01259/LBC (Listed Building Consent) – 3 Thorn Mews, The Green – Proposed replacement of render to improve home appearance and help to insulate and protect against the elements – Following the vote, the Committee recommended that the LPA’s Heritage Officer makes a decision under the LPA’s scheme of delegation. (Proposed by Councillor Bell and seconded by Councillor Carter).

c) 21/01452/TCA – (Tree Conservation Area) – 2 Nelson Villas, The Park – 1 No Silver Birch – remove – Following the vote, the Committee recommended that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation. (Proposed by Councillor Bell and seconded by Councillor Carter).

d) 21/01457/TCA – (Tree Conservation Area) – Swan House, High Street – 1 No. Holm Oak – Maintenance reduction as previous years – Following the vote, the Committee recommended that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation. (Proposed by Councillor Bell and seconded by Councillor Carter).

e) 21/00046/FUL – (Full Householder Application) – Tops’l House, High Street – Proposed external staircase, balcony, window to a door to The Quay elevation and a window to a door to the north-west elevation – Following the vote, the Committee recommended that this application be refused on the grounds of this being an inappropriate development in this area, the proposal would change the structure of the building significantly and adversely affect the character in the Conservation Area – which is near to many listed buildings, the loss of residential amenity to neighbours, no parking provision and non-viability of a business in this area. (Proposed by Councillor Peacock and seconded by Councillor Carter). Councillor Bell abstained from the vote given his declaration of interest under Minute Number 3 above.

8. Planning Applications received from the LPA after Agenda distributed

a) 21/00040/FUL – Tops’l House, High Street – Proposed external changes to fenestration including: The change of a window to a door to the front elevation and change of a window to a door to the Quay elevation – (Proposed by Councillor Peacock and seconded by Councillor Carter). Following the vote, the Committee recommended that this application be refused on the grounds of this being an inappropriate development in this area, the proposal would change the structure of the building significantly and adversely affect the character in the Conservation Area – which is near to many listed buildings, the loss of residential amenity to neighbours, no parking provision and non-viability of a business in this area. Councillor Bell abstained from the vote given his declaration of interest under Minute Number 3 above.

b) 21/01503/TCA – 1 Croft Cottage, The Chase – 1 No. Silver Birch – Reduce crown by 2-3 metres back to suitable growth points – Following the vote, the Committee recommended that the LPA’s Tree and Landscape Officer makes a decision under the LPA’s scheme of delegation. (Proposed by Councillor Peacock and seconded by Councillor Bell).

9. Public Inquiries, Appeals or Enforcement Matters – The Committee noted the ongoing three appeals and received and noted the paper submitted by the local District Councillors regarding these appeals.

10. Date of Next Planning Committee Meeting – Thursday 7th October 2021 – 7.30pm – Mistley Village Hall – This Meeting was noted.

There being no further business the Meeting closed at 8.12pm.
