1. Welcome and Apologies for Absence – Apologies for absence were received from Councillors Bell (work), Carter (meeting clash), Coiley (medical procedure), Frost (bereavement leave), Howell (work) and Kent (unwell).

2. Public Voice – No Members of the Public were present.

3. Declarations of Interest – There were none.

4. Minutes of the Previous Planning Committee Meeting – The Minutes of the Planning Committee Meeting held on the 3rd March 2022 were received, considered, and agreed following the vote. (Proposed by Councillor Cunningham and seconded by Councillor Meston). (Copy in Minute Book and on Website).

5. Matters Arising/Updates from Previous Minutes – There were no matters.

6. The Committee noted Planning Decisions from the LPA (Local Planning Authority) as follows:

a) 21/02028/FULHH – 46 New Road – Proposed front canopy, single storey side extension, single storey rear extension – The Committee noted that the LPA has approved this application.

b) 21/02069/FUL – Post Office, High Street – Single storey rear extension, internal and external alterations, and part change of use from Post Office to residential – The Committee noted that the LPA has approved this application.

c) 21/02089/LBC – Post Office, High Street – Single storey rear extension, internal and external alterations – The Committee noted that the LPA has approved this application.

d) 21/02112/FULHH – Evora, Clacton Road, Horsley Cross – Proposed two storey side and rear extension to form utility, WC, bedroom, and bathroom – The Committee noted that the LPA has approved this application.

e) 21/0052/FULHH – 25 Kiln Lane – Proposed part removal of conservatory and erection of tiled roof and new glazing – The Committee noted that the LPA has approved this application.

f) 22/00198/TCA – Mistley Wood and Trees adjacent to Clacton Road – 1 No. Lime – fell, Clacton Road boundary; 1 No. Wild Cherry – reduce by 3-4m, and 1 No. Cherry – fell – The Committee noted that the LPA has approved this application.

g) 22/00201/TPO (Tree Preservation Order) – Mistley Hall Cottage, Clacton Road – 1 No. Common Ash – fell. 1 No. Common Oak – fell – The Committee noted that the LPA has approved this application.

h) 22/00203/TPO (Tree Preservation Order) – Spring Lodge, Acorn Village Community, Clacton Road – 1 No. Horse Chestnut – The Committee noted that the LPA has approved this application.

i) 22/00/204/TCA (Tree Conservation Area) – Spring Lodge, Acorn Village Community, Clacton Road – 1 No. Holm Oak – reduce dead centre stem, reduce all main stems and branches – The Committee noted that the LPA has approved this application.

j) 22/00205/TPO (Tree Preservation Order) – Mistley Hall, Clacton Road – 1 No. Honey Locus – fell due to Ganoderma fungus – The Committee noted that the LPA has approved this application.

k) 22/00206/TCA (Tree Conservation Area) – Mistley Hall, Clacton Road – 1 No. Sycamore – fell. 1 No. Silver Birch – remove – The Committee noted that the LPA has approved this application.

l) 22/00207/TPO (Tree Preservation Order) – Catkins Corner, Acorn Village Community, Clacton Road – 1 No Maple – fell – The Committee noted that the LPA has approved this application.

m) 22/00208/TCA (Tree Conservation Area) – Catkins Corner, Acorn Village Community, Clacton Road – 1 No Walnut – fell. 1 No. Silver Birch – fell – The Committee noted that the LPA has approved this application.

n) 21/01377/LBC – Mistley Church Hall, New Road – Replace wooden doors at rear of building on WWII extension and investigation and remedy leak to the rear gable near to where it joins the WWII extension – The Committee noted that the LPA has approved this application.

o) 22/00016/FUL – Anchor Inn, Harwich Road – Proposed erection of front entrance porch – The Committee noted that the LPA has approved this application.

p) 22/00037/FULHH – 48 Rigby Avenue – Proposed single storey side extension and front porch – The Committee noted that the LPA has approved this application.

q) 22/00288/TCA – Honeypot House, 25 New Road – 1 No. Cedar – Prune overhanging limbs by up to 2 metres – The Committee noted that the LPA has approved this tree application.

r) 22/00113/FUL – 4 Long Road – Proposed replacement of existing conservatory with new two storey extension – The Committee noted that the LPA has approved this application.

s) 21/00453/FUL – Land at Mistley Place Park, New Road – Proposed development of land to provide retirement living accommodation comprising of 42 apartments and 10 bungalows with associated amenity and landscaping, landscaping improvements to Mistley Place Park, new access to New Road and associated works, (revised drawings and supporting statements received 20/12/21, re-consultation) – The Committee noted that the LPA has refused this application.

7. Planning Applications/Proposals received from the LPA (Local Planning Authority):

a) 22/00262/FULHH & 22/00263/LBC – Park Manse, 24 New Road – Proposed alterations and extension to house. Erection of garden building – The Committee noted the Heritage Team’s comments and observations. Following the vote, the Committee recommended approval for both applications. (Proposed by Councillor Cunningham and seconded by Councillor Meston).

b) 22/00367/S106A – Land South of Long Road – Deed of variation under TCPA (Town and Country Planning Act) 1990 Section 106A of the terms of the Unilateral Undertaking (UU) dated 30th October 2019 linked to outline planning permission 17/01181/OUT – (Approved under appeal APP/P1560/W/19/3220201 and separately via 21/00213/OUT) – To the effect that the open space within the scheme will, instead of being transferred to the Council, be transferred into the ownership of a private management company to secure its management and maintenance in perpetuity – Following the vote, the Committee recommended objecting to this proposal in the interests of the future residents and that it is preferable to adhere to the Section 106 Developer Agreement with the District Council which is already in place. (Proposed by Councillor Cunningham and seconded by Councillor Meston ).

c) 22/00264/FULHH – Tangletrees, Trinity Road – Proposed erection of single storey rear extension with front pitched roof dormer. Removal of chimney stack and installation of 3 No. Velux rooflights, with replacement cladding. Removal of side and front windows and reduce depth of side windows. The Committee noted that the LPA has already approved this application.

d) 21/02121/LBC & 21/02122/FULHH – 2 Thorn Mews, The Green – (Revisions) – Proposed erection of two rear dormers, insertion of 2 No. conservation roof lights to front roof slope and internal alterations. To note. Due to the timescales and deadlines, at the Parish Council Meeting on the 21 March 2022, the Council recommended that the LPA’s Heritage Officer makes a decision on this application via the LPA’s scheme of delegation. The Committee noted this.

e) 22/000397/LBC – 5 The Green – Proposed 2 No. replacement timber sash windows – The Committee noted that traditional materials are being proposed. Following the vote, the Committee recommended approval. (Proposed by Councillor Peacock and seconded by Councillor Cunningham).

f) 22/00410/NMA – Land South-West of Horsley Cross Roundabout, Clacton Road, Horsley Cross – Non-Material Amendment sought to application 19/01706/OUT to amend conditions 22, 24, 26 and 36 to facilitate the commercial viability of the site – The Committee noted this amendment which is for information only.

g) 22/00507/TCA – Rill House, 54 New Road – Front: 1 No. Hornbeam – re-reduce, 1 No. Sycamore – re-reduce, 1 No. Portugal Laurel – reduce 30%, 1 No. Norway Maple – reduce back to old cuts, 1 No. Bay Tree – reduce by 50% and shape, 1 No. Lime – re-reduce, 2 No. Conifers – top by 50% roughly to Yew height, 1 No. Sycamore – reduce by 30%. Back: 1 No. Trump Apple – thin 25%, 1 No. Holly – reduce by 30%, Lime covered in sucker growth re-reduce, 1 No. Lime – reduce to same height. Face off all trees back by 3-4m up to fence. Sucker growth off base of trees – Following the vote, the Committee recommended approval. (Proposed by Councillor Chaplin and seconded by Councillor Meston).

h) 22/00449/FULHH – 41 Harwich Road – Proposed two storey side extension and single storey rear extension – The Committee noted that there are currently no neighbouring objections. Following the vote, the Committee recommended making “no comment”. (Proposed by Councillor Cunningham and seconded by Councillor Meston).

8. Planning Applications received from the LPA after Agenda distributed

a) 22/00575/TCA – Welcome Home Field, Mistley Cricket Club, New Road – 3 No. Oak – crown lift – As the Parish Council is sole trustee to the Welcome Home Trust, the Committee simply noted this tree conservation area planning application.

b) 22/00545/FULHH – Dormy Lodge, 83 New Road – Proposed removal of existing flat roof extension. Construction of new single-storey rear extension – The Committee discussed the history of this property and that noted that the applicants have commenced a dialogue with the LPA’s Heritage Officer.

Following the vote, the Committee recommended approval. (Proposed by Councillor Meston and seconded by Councillor Peacock).

9. Public Inquiries, Appeals or Enforcement Matters – There were no new updates.

10. Date of Next Planning Committee Meeting – Thursday 5th May 2022 – 7.30pm – Mistley Village Hall – This Meeting was noted.
